Terms & Conditions
1. Membership (including Casual Attendance)
General Terms
- Memberships are personal and non-transferable.
- Members must be 18 years or older, or have parental/guardian consent if under 18.
- All classes and services are subject to availability and require advance booking.
- Holistica Pilates reserves the right to update class schedules, instructors, hours of operations, conditions of membership and studio policies at any time. Members will be notified of any changes via email and in-studio announcements, ensuring members always feel informed and supported.
- Members are responsible for notifying Holistica Pilates of any updates to their contact information, payment accounts, or other details required to maintain their membership.
- Members are expected to respect studio etiquette, equipment, and fellow participants. Holistica Pilates reserves the right to cancel a membership if a member fails to comply with the studio’s Safety Guidelines, engages in conduct deemed inappropriate within the studio, or for any other reason the management considers reasonable. In such circumstances, Holistica Pilates may also refuse membership.
Member Warranties
- Members warrant that:
- they have the legal capacity and are of sufficient age to enter into this Agreement; or
- where under 18 years of age, a parent or legal guardian has provided consent on their behalf.
Payment Terms
- Membership fees are payable in advance through approved methods on Momence, including credit card or direct debit, with standard processing fees applied.
- Recurring memberships will be automatically charged every 28 days, in accordance with the billing cycle agreed to at sign-up.
- Members are responsible for maintaining valid payment details.
- If a scheduled payment is declined, Holistica Pilates and its payment processor (Stripe) may apply a Payment Declined Fee.
- Late or failed payments may result in suspension of membership access until resolved.
Cancellation Policy
- Members may cancel their membership by providing written notice at least 14 days before the next billing cycle.
- Cancellations received after this period may result in charges for the upcoming billing cycle.
- Holistica Pilates reserves the right to cancel memberships due to non-compliance with studio policies, inappropriate conduct, or repeated late payments.
Membership Suspension / Holds
- Membership suspension may be granted for medical reasons, pregnancy, holidays, or other circumstances preventing regular practice, subject to the following conditions:
- Holds must be for a minimum of one (1) week.
- Holds may not exceed twelve (12) weeks.
- Members must provide at least fourteen (14) days’ written notice by emailing [email protected].
- In cases of injury or illness, shorter notice may be accepted; a medical certificate may be requested.
- Upon returning from a medical hold, members acknowledge that they resume exercise at their own risk and agree to update their waiver.
Returns / Refunds
- Membership fees are non-refundable once the billing cycle has commenced.
- Refunds may be considered only in exceptional circumstances (e.g., medical reasons) at the discretion of Holistica Pilates management.
- Class packs and prepaid services are valid until their stated expiry date and cannot be extended or refunded once expired.
Studio Access & Booking
- All sessions must be reserved through Momence using the member’s personal profile.
- Access to the studio will not be permitted if a membership is inactive due to cancellation, suspension, or unresolved billing issues.
Privacy & Communications
- Holistica Pilates respects member privacy and complies with applicable data protection laws.
- Personal information collected during membership sign-up and participation will be used solely for studio operations, communication, and service delivery.
- Members may receive marketing communications electronically, including newsletters and promotional content. An unsubscribe option is available at any time.
- Data will not be shared with third parties without consent, except where required by law.
- Members may request access to, correction of, or deletion of their personal information by contacting the studio.
2. Liability Waiver & Informed Consent
Assumption of Risk
- Members acknowledge that participation in Pilates classes and related activities involves inherent risks, including but not limited to physical exertion, slips, falls, muscle strain, or injury.
- By engaging in these activities, members voluntarily assume all risks associated with participation.
Medical Clearance & Responsibility
- Members affirm that they are physically fit to participate and have consulted a qualified medical professional if they have any concerns about their health or ability to exercise.
- Pregnant members may only attend designated prenatal classes and must provide written clearance from a qualified medical practitioner.
- Members are responsible for monitoring their own physical condition and agree to stop any activity that causes discomfort or pain.
- Members acknowledge that any babies or children (“bubs”) brought into the studio for Mum & Bub classes remain entirely the responsibility of the member at all times. Members accept full responsibility for their bub’s safety and wellbeing while on the premises and agree to indemnify Holistica Pilates against any injury, incident, or damage involving their bub. Refer to the Mum & Bub Class Addendum.
Waiver of Liability
- Members release, waive, and discharge Holistica Pilates, its owners, instructors, employees, and contractors from any liability for injury, loss, or damage arising from participation in studio activities, except where prohibited by law.
- This waiver extends to claims resulting from negligence, provided such negligence does not amount to gross negligence or willful misconduct.
Informed Consent
- By signing this agreement, members confirm they understand the nature of Pilates activities, the potential risks involved, and the importance of following all safety instructions provided by instructors and staff.
- Members consent to participate fully, acknowledging that they do so at their own risk.
Indemnity
- Members agree to indemnify and hold harmless Holistica Pilates, its owners, instructors, employees, and contractors against any claims, damages, or expenses arising from their participation or breach of studio policies.
- This includes any claims arising from the presence, actions, or safety of their bub during Mum & Bub classes. Refer to the Mum & Bub Addendum.
Acknowledgement
- Members confirm they have read, understood, and voluntarily agree to the terms of this Liability Waiver & Informed Consent.
- This agreement remains in effect for the duration of their membership and participation at Holistica Pilates.
2.1 Mum & Bub Class Addendum
Supplement to the Holistica Pilates Liability Waiver & Informed Consent
This Addendum applies to all members participating in Mum & Bub classes at Holistica Pilates and forms part of the Liability Waiver & Informed Consent agreed to upon membership.
Responsibility for Babies (“Bubs”)
- Members acknowledge that any babies or children (“bubs”) brought into the studio for Mum & Bub classes remain entirely under the care, supervision, and responsibility of the member at all times.
- Holistica Pilates does not provide childcare, supervision, or monitoring of bubs during any class or while on the premises.
Safety & Conduct
- Members agree to ensure their bub is positioned safely and appropriately throughout the class, including during transitions, equipment use, and movement sequences.
- Members must keep all personal items, prams, carriers, and baby-related equipment clear of walkways and studio apparatus to maintain a safe environment for all participants.
- If a bub becomes unsettled, distressed, or poses a safety risk to themselves or others, members agree to pause participation and attend to their bub as needed.
Assumption of Risk for Bubs
- Members understand that the studio environment contains equipment, movement, and activity that may pose risks to bubs, including but not limited to falls, contact with equipment, or accidental interactions with other participants.
- By bringing their bub into the studio, members voluntarily assume all risks associated with their bub’s presence.
Indemnity
- Members agree to indemnify and hold harmless Holistica Pilates, its owners, instructors, employees, and contractors from any claims, damages, injuries, or expenses arising from or relating to their bub’s presence in the studio.
- This includes any incident, accident, or injury involving their bub, whether occurring during class or elsewhere on the premises.
Acknowledgement
- By attending Mum & Bub classes, members confirm they have read, understood, and agree to the terms of this Addendum.
- This Addendum remains in effect for the duration of their participation in Mum & Bub classes at Holistica Pilates.
3. Safety Guidelines
General Conduct
- Members must follow all instructions provided by instructors and staff during classes and studio activities.
- Respect for fellow members, instructors, and studio property is expected at all times.
- Food and drink (other than water) are not permitted in studio practice areas.
Health & Medical Considerations
- Members are responsible for ensuring they are medically fit to participate in Pilates activities.
- Any pre-existing medical conditions, injuries, or pregnancy must be disclosed to the studio prior to participation.
- Pregnant members may only attend designated Prenatal classes and must provide medical clearance from a qualified practitioner.
- Members experiencing illness, fever, or contagious conditions should refrain from attending classes until fully recovered.
Equipment & Studio Use
- Members must use equipment only as instructed by staff.
- All equipment should be cleaned after use with the provided sanitising materials.
- Personal belongings must be stored in designated areas and not left in practice spaces.
Attire & Hygiene
- Appropriate workout clothing and grip socks are required for all Pilates sessions.
- Members must maintain personal hygiene to ensure a safe and comfortable environment for all participants.
Emergency Procedures
- Members must familiarise themselves with emergency exits and procedures.
- Any accidents, injuries, or hazards must be reported to staff immediately.
- Holistica Pilates reserves the right to suspend or cancel membership if safety guidelines are not followed.
